• Driver’s from out of state are not protected from license suspensions stemming from DWI or Refusal convictions in New Jersey. While New Jersey cannot revoke an out of state driver’s license, New Jersey will suspend that person’s privilege to drive in New Jersey. New Jersey will also notify the Department of Motor Vehicles in the driver’s home state of the suspension, and that state, in compliance with the Interstate Driver’s Compact, will suspend the driver’s license.

• When operating a boat you are subject to the same laws for a DUI/DWI or Refusal, as if you were operating a vehicle. You will be subject to being arrested and charged if you operate a boat while having a blood alcohol limit that is 0.08% or higher or if you are deemed to be under the influence of drugs or alcohol.

• The penalties for DWI while boating are the same as for DWI while driving. You are also under an obligation to give a breath sample and to submit to blood testing just as you would with driving a vehicle. Refusal to do so will also carry the same consequences. Any license suspension imposed for boating will affect your driver’s license, as well.
